ORDER

This Criminal Original Petition has been filed by the petitioner to quash the FIR in Crime No.64 of 2024 on the file of the 1 st respondent police.

The learned counsel for the petitioner submitted that both the petitioner and the defacto complainant were doing online trading business and initially, they both enjoyed the profit and subsequently, there was some loss due to which, a false case has been foisted against the petitioner and that the petitioner has not committed any offence as alleged by the prosecution. Hence, the present petition is filed to quash the FIR.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the 1 st respondent police and also perused the materials available on record.

4. Since no adverse order is being passed against the 2 nd respondent, notice to the 2 nd respondent is dispensed with.

5. On a perusal of the FIR shows prima facie allegations against petitioner. Therefore, this Court is not inclined to quash the FIR.

6. Further, it is seen that the occurrence has taken place on 04.04.2023 and the FIR has been registered on 01.03.2024. Therefore, the respondent police is directed to complete the investigation and file the charge sheet within a period of three months from the date of receipt of a copy of this order.

7. With the above directions, this Criminal Original Petition is dismissed. Consequently, the connected Miscellaneous Petition is closed. 23.06.2025 Index : Yes / No Speaking Order : Yes / No ksa-2 3/5
