This is the second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 03.02.2022 for the offences punishable under Sections 5(1)(m) r/w 6 of POCSO Act, in crime No. 02 of 2022 on the file of the respondent police.

2. The case of the prosecution is that the victim girl aged about 9 years was attending her tuition. During the course of time, the petitioner kidnapped the victim minor girl to his house and sexually abused the victim minor girl. Hence, the complaint.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.13811 of 2022, on 16.06.2022, considering the fact that the petitioner had committed very serious and heinous offence as against the minor victim girl aged about 9 years.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner.
