PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India to set aside the order and decreetal order dated 29.07.2022 made in I.A.No.1 of 2022 in HMOP No.391/2020 by the Subordinate Judge, Poonamallee.

O R D E R

This Civil Revision Petition has been filed to set aside the order and decreetal order dated 29.07.2022 passed in I.A.No.1 of 2022 in HMOP No.391/2020 by the learned Subordinate Judge, Poonamallee.

2. The petitioner herein is the husband and the respondent herein is his wife. The respondent/wife has filed HMOP No.391/2020 before the Trial Court to dissolve the marriage solemnized between her and the respondent herein, in which the petitioner herein was set exparte on 29.03.2022. To set aside the above exparte order, the petitioner herein has filed I.A.No.1/2022 under Order XI Rule 7 of CPC and Section 151 of CPC and it was dismissed on 29.07.2022. Challenging the above order, the present civil revision petition has been filed.

3. Today, when the matter is taken up for hearing, the learned counsel petitioner as well as the respondent submitted before this Court that, now, the husband and wife have settled the matter and the petitioner herein has

no objection for giving diverse to the respondent/wife and for the same, he is ready to pursue the matter before the Trial court.

4. Recording the submission made by the learned counsel appearing on either side, the order passed in I.A.No.1/2022 in HMOP No.391/2020, dated 29.03.2022 by the learned Subordinate Court, Poonamallee is set aside and the civil revision petition is allowed.
