Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents to release the terminal benefits to the petitioner such as Death-Cum-Retirement, Gratuity, Commutation pension, provident fund and special provident fund, reimbursement for earned leave and unearned leave lying to the credit of the petitioner and consequently direct the respondents to conclude the disciplinary proceedings against the petitioner within a time frame to be fixed by the Hon'ble Court. O R D E R

The prayer sought for in this Writ Petition is to direct the respondents to release the terminal benefits to the petitioner such as Death-Cum-Retirement, Gratuity, Commutation pension, provident fund and special provident fund, reimbursement for earned leave and unearned leave lying to the credit of the petitioner and consequently direct the respondents to conclude the disciplinary proceedings against the petitioner within a time frame to be fixed by the Hon'ble Court.

2. The case of the petitioner is that, she joined the service of the respondent department in the year 1982. On 30.04.2019, she retired from the service on superannuation. It is her case that till date the terminal benefits such as DeathCum-Retirement Gratuity, Commutation pension, provident fund and special provident fund, reimbursement for earned leave and unearned leave was not released. Hence the Writ Petition has been filed.

Ms.Dakshayani Reddy, learned counsel for the petitioner would submit that, in the counter filed by the Government Advocate it was stated that some enquiry is pending against the petitioner and other members. Therefore she implored this Court to give directions to the respondents to complete the enquiry and disburse the terminal benefits in favour of the petitioner.

4. The learned Government Advocate appearing for the respondents would concede the request made by the learned counsel for the petitioner.

5. In view of the above, I am inclined to issue directions to the respondents to complete the enquiry within a period of 12 weeks from the date of receipt of a copy of this order and disburse the terminal benefits in favour of the petitioner, as expeditiously as possible.

6. The Writ Petition is disposed of with the above directions. No costs. Consequently, connected Miscellaneous Petition is also closed.
