ORDER

This Criminal Original Petition has been filed to direct the second respondent to register the case based on the complaint given by the petitioner dated 04.07.2022.

2. The learned counsel appearing for the petitioner submitted that on 03.07.2022 at 3.00 pm some rowdy elements, as per the instruction of the petitioner's wife, had formed an unlawful assembly and threatened him with dire consequences using deadly weapons. Therefore, the petitioner gave a complaint against his wife and her family members. However, till date, no FIR has been registered. Hence, the present petition has been filed.

3. The learned Government Advocate (crl.side) appearing for the respondents submitted that on the basis of the complaint given by the petitioner, enquiry has been conducted in C.No.12 of 2022. During the course of enquiry, it came to light that the allegations made by the petitioners are not true and therefore, the complaint has been closed as mistake of fact. 2/4

Recording the submissions made by the learned Government Advocate (crl.side) that the complaint has been closed as mistake of fact, this Criminal Original Petition stands dismissed by giving liberty to the petitioner to work out his remedy in the manner known to law. 10.01.2023 shk To 1.The Commissioner of Police, Salem Town & District 636 002.
