O R D E R
This Criminal Revision has been filed challenging the order dated 09.04.2025 passed in Crl.MP.No.664 of 2025 by the Additional District Judge/Presiding Officer, Special Court for Essential Commodities Act Cases, Coimbatore, thereby dismissing the application seeking return
of the property.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner owned a Ashok Leyland, Bada Dost four wheeler, bearing Registration No.TN-37-EW-5116, which was used by the accused for the transportation of ganja weighing six kilograms. During the routine check up, the respondent Police found the petitioner in possession of the contraband. Pursuant to the registration of the FIR in Crime No.59 of 2024 for the offences punishable under Section 8(c), 20(ii)(B) read with Section 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985, the said vehicle was seized by the respondent police. Thereafter, the seized vehicle was produced before the Trial Court and the confiscation proceedings have now been initiated against the said vehicle. Therefore, the Trial Court rightly dismissed the petition seeking return of the vehicle.
4. In view of the above, this Court finds no infirmity or
illegality in the order dated 09.04.2025 passed in Crl.MP.No.664 of 2025 by the Additional District Judge/Presiding Officer, Special Court for Essential Commodities Act Cases, Coimbatore. Accordingly, this Criminal Revision Case stands dismissed.
