ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.05.2026 for the alleged offence punishable under Section 108 of the Bharatiya Nyaya Sanhita (BNS), 2023, in Crime No.276 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that following a matrimonial dispute, a wordy quarrel broke out between the petitioner and his wife. Driven by the instigation and harassment of the petitioner, his wife allegedly committed suicide. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent. He states that the petitioner did not suppress the death of his wife. Instead, he immediately informed the defacto complainant, who is the aunt of the deceased. He further submits that the petitioner has been falsely implicated without any substantial material or evidence on record, and prays for the grant of bail.

4. The learned Government Counsel (Criminal Side) appearing for the respondent police vehemently opposes the grant of bail. He reiterates the case of the prosecution, emphasizing the gravity of the offence under Section 108 of the BNS involving the loss of a human life. He further submits that the investigation is pending, and if the petitioner is released on bail at this stage, there is a strong possibility of him absconding or tampering with vital prosecution witnesses.

5. Considering the facts and circumstances of the case, this Court takes a serious view of the allegations involving the suicide of a spouse arising out of matrimonial dispute. The offence is grave, and the investigation is still in its initial stages. Therefore, considering the stage of the investigation and the nature of the offence, this Court is not inclined to grant bail to the petitioner.
