ORDER

The present criminal original petition has been filed to call for the records in Crime No.51 of 2012 pending on the file of the first respondent police and quash the same.

2. Today, when the matter was taken up for consideration, learned counsel appearing for the petitioners and the learned counsel appearing for the second respondent / de https://hcservices.ecourts.gov.in/hcservices/

facto complainant represented that the dispute between the parties was amicably settled and the second respondent has also filed an affidavit to that effect, which reads as follows:- " 2. I submit that pursuant to the complaint given by me, the petitioners were arrested on 11.5.2012 and before their remand, settlement was arrived at and despite our joint request, the first respondent remanded the petitioners on 11.5.2012 at 22.30 p.m.

3. I submit that in the enquiry in the bail application before the Judicial Magistrate, Alandur, I have filed an affidavit about the settlement amongst ourselves.

I submit that all the documents came into being in the year 2006-2007, at the instance of petitioners have been handed over to me and petitioners have executed the deed of cancellation on 24.5.2012 under document No.3876/2012, SRO, Selaiyur." Thus, the learned counsel for the respective parties pleaded that recording the averments made in the affidavit filed by the second respondent, the case may be closed.

3. Therefore, recording the averments made in the affidavit filed by the second respondent, the criminal original petition is closed. Consequently, connected miscellaneous petition is also closed.
