This Civil Miscellaneous Petition has been filed seeking to condone the delay of 35 days in filing the above appeal against the order dated 22.09.2022 made in M.C.O.P.No.469 of 2021 on the file of the Motor Accidents Claims Tribunal / Special Sub Court No.II, Salem.
2.Notice to respondents 1 & 2 is dispensed with since, they remained exparte before the Tribunal. Notice has been served on the 3rd respondent and Mr.M.Krishnamoorthy, learned counsel undertakes to file vakalat on behalf of the 3rd respondent.
4.Heard the learned counsel for the petitioner and 3rd respondent and perused the records.
5.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 35 days is condoned.
6.The name of the counsel for the 3rd respondent shall be printed in the cause list at the time of admission.
