ORDER

This Criminal Miscellaneous Petition has been filed seeking permission to withdraw the amount of Rs.53,000/-, which was deposited before the learned Judicial Magistrate, Paramathi, pursuant to Challan dated 27.03.2023 bearing Challan No.002030 in STC.No.94 of 2021 on the file of the Judicial Magistrate, Paramathi.

2. Heard both sides.

3. In view of the settlement arrived between the parties in terms of the Joint Memo of Compromise dated 17.12.2024, this Court set aside the conviction and acquitted the respondents. Therefore, the petitioner, being the complainant, sought for permission to withdraw the amount which was already deposited to the credit of the Trial Court.

4. Considering the above, the petitioner is permitted to withdraw a sum of Rs.53,000/-, which was already deposited by the respondents to the credit of STC No.94 of 2021 on the file of the Judicial Magistrate, Paramathi. It is made clear that the Trial Court is directed to permit the petitioner to withdraw the said amount, without ordering notice to the respondents.
