ORDER
This Criminal Original Petition has been filed to direct the Learned Principal District and Sessions Court at Kallakurichi (Special Court) to accept the surrender of the petitioner and consider the bail petition on the same day in crime No.357 of 2024 on the file of 2nd respondent police and thus render justice.
2.Heard the learned Govt. Advocate (Crl.Side) appearing for respondents 1 and 2 and perused the materials on record.
3.It is seen that in this case, the defacto complainant sent a follow request to a girl named Diya, who refused it. However, he kept sending repeated requests. This was questioned by one Balaji (A1). Balaji called the defacto complainant to come to a petrol bunk, where the petitioner (A2) and others assaulted the defacto complainant and abused him using his caste name. 4.In view of the above factual position, there shall be a direction to the the Learned Principal District and Sessions Court at Kallakurichi (Special Court) to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.357 of 2024 on the file of the 2nd
respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
