This miscellaneous petition has been preferred to suspend the sentence imposed on the petitioner in Spl.S.C.No.12 of 2020 dated 19.07.2022 by the learned Sessions Judge, Principal Special Court for Exclusive Trial of Cases under POSCO Act, Salem and enlarge the petitioner on bail.
2.Heard the learned counsel on either side and perused the materials available on record.
3.Since the petitioner was found guilty for the offences under the POCSO Act, this Court is not inclined to suspend the sentence and hence, this Miscellaneous Petition is dismissed. On the other hand, this Court is inclined to take up the main appeal itself ''for final disposal'' soon after receipt of the entire records.
4. In the earlier occasion i.e on 18.08.2022 this Court directed the Registry to call for the records from the Court below on or before 07.12.2022. 5.Since this Court is inclined take up the main appeal ''for final
disposal'' earlier, the Registry is directed to call for the records from the Court below on or before 21.09.2022 and thereafter, prepare typed set of papers on or before 30.09.2022 and serve copies on the learned counsel on either side well in advance.
6.List the matter under the caption ''for final disposal'' on 18.10.2022.
