ORDER : The Court Made the following order :- The petitioner, who was arrested on 01.08.2021 and remanded to judicial custody for the alleged offences punishable under Sections 376 & 417 IPC, in Crime No.134 of 2021 on the file of the respondent police, seeks bail.

2. This is the third bail application filed before this Court. The case of the prosecution is that there was a love affair between the petitioner and the defaco complainant. Further, the petitioner had false promised to marry her and thereafter, the petitioner has made sexual intercourse with her. Thereafter, the petitioner had refused to marry the victim girl. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offences and he has been falsely implicated in this case. He further submits that the petitioner has been in jail from 01.08.2021. Hence he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner had false promised to marry the victim girl and thereafter, the petitioner has made sexual intercourse with her. Thereafter, the petitioner had refused to marry the victim girl. He further submitted that earlier bail applications were dismissed by https://hcservices.ecourts.gov.in/hcservices/

this Court in Crl.O.P.No.14334 and 17397 of 2021 and there is no change of circumstances. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that earlier bail applications were dismissed by this Court and there is no change of circumstances, the petitioner has involved in very serious offence, this Court is not inclined to grant bail to the petitioner.
