ORDER

The petitioner/accused in F.I.R.No.299 of 2025 for offence under Section 108 of BNS, 2023 had filed this quash petition.

2. The learned counsel for the petitioner submitted that the petitioner was arrayed as accused in Crime No.299 of 2025 and arrested in this case only on the basis of an Instagram post and no other material was available against her. He further submitted that the de facto complainant/second respondent is the husband of the deceased. The de facto complainant earlier employed as Mason under the petitioner and at that time, his wife was cooking food for others. The de facto complainant questioned the deceased for giving money to the petitioner, thereafter the de facto complainant and his wife/deceased left the employment and they were working in Tiruppur. Later, the de facto complainant's wife committed suicide for which, the petitioner has been falsely implicated in this case.

3. The learned Government Advocate submitted that it is a pathetic case, in which, the deceased along with her younger son, aged about 3 years died due to drowning. Her elder son, aged about 8 years was holding the phone of the deceased in which, the deceased posted a message along with the petitioner's photo that nobody should believe Kalyani. He further submitted that in this case

investigation is in progress. The mobile phone of the deceased seized and sent for forensic examination. The petitioner is further needed for enquiry, her phone to be collected. The evidence of witnesses recorded and there are materials and evidence against the petitioner.

4. Considering the above facts and circumstances of the case, this Court is not inclined to entertain this petitioner. Hence, the Criminal Original Petition is dismissed.

5.Finding that there were serious flaws in this case, this Court directs the Deputy Superintendent of Police, Jayankondam to further continue with the investigation and file final report in this case. The Inspector of Police, Vikiramangalam Police Station to hand over the Case Diary forthwith to the Deputy Superintendent of Police, Jayankondam and the Superintendent of Police, Jayankondam is directed to monitor the investigation.
