CMP.Nos.16366, 16370 and 16373 of 2023 in CMA.No.3664 of 2019 M.DHANDAPANI,J These petitions are filed by the petitioners seeking to condone the delay of 1458 days in filing the petition to set aside the abatement caused due to the death of the sole appellant in the main appeal, to set aside the abatement caused due to the death of the sole appellant and to bring the petitioners 2 to 5 on record as the legal heirs of the deceased sole appellant and rank them as respondents 2 to 5 in the main appeal.

2. Learned counsel for the respondents have no serious objection for the petitions being allowed.

3. Having satisfied with the reasons stated in the affidavit, the delay is condoned and the petitions are allowed. It is made clear that the claimants will not be entitled for any interest for the delay period of 1458 days.
