ORDER

(Order of the Court was made by J.NISHA BANU, J.) The present Writ Petition is filed for the issuance of a Writ of Mandamus directing the respondent to consider the application of the petitioner dated 19.5.2021 and reminder dated 3.3.2025 and to issue community certificate to the petitioner and his children Rakshika and Deeshik that they belong to Kattunayakan (ST) Community based upon the report of the State Level Scrutiny Committee in proceedings No.19341/CV-II/2010-5 dated 28.3.2014 in respect of petitioner's cousin brother B.Gugan.

It is the case of the petitioner that the Community Certificate was issued to the petitioner's cousin brother namely, B.Gugan, which was verified by the State Level Scrutiny Committee and found that he belongs to Kattunayakan (ST) Community. The petitioner has two children namely, Rakshika and Deeshik. Since the Community Certificate is required for his children, the petitioner preferred an application to the respondent on 19.05.2021 requesting to issue Community Certificate to the petitioner and his children and the same was forwarded by the Revenue Divisional Officer, Tiruvannamalai, to the Tahsildar, Thandrampattu, on 26.05.2021, to conduct an enquiry and submit a report.

Thereafter, the Village Administrative Officer and the Revenue Inspector conducted an enquiry and concluded that the petitioner belongs to Kattunayakan (ST) Community and sent a report to the respondent. However, till date, no order was passed by the respondent. Hence, the present Writ Petition is filed.

3. The learned Additional Government Pleader appearing for the respondent submits that the petitioner has to apply for issuance of a Community Certificate through online. If an application is filed through online, the same will be considered based on the report submitted by the Village Administrative Officer and the Revenue Inspector.

4. Heard the learned counsel appearing for the petitioner as well as the learned Additional Government Pleader appearing for the respondent and perused the materials placed before this Court.

5. Considering the facts and circumstances of the case, this Court directs the petitioner to apply for Community Certificate through online within a period of two (2) weeks from the date of receipt of a copy of this order. On such application being filed by the petitioner through online, the respondent shall consider the same and pass orders, on merits and in accordance with law, within a period of eight (8) weeks thereafter, by taking into consideration the report filed by the Village Administrative Officer and the Revenue Inspector, if any.

6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
