The petitioner has been granted anticipatory bail by the Sessions Court, Chennai, on certain conditions, one of which is that, "[iii] Petitioner shall also deposit title deeds worth Rs.1Lakh before the said Magistrate." Seeking modification of the said condition, this petition has been filed. 2.It is the case of the petitioner that he does not have any immovable property in his name and therefore, he is not in a position to comply with the said condition.
3.Taking into consideration the nature of allegations in the FIR and the admitted fact that the petitioner has paid Rs.1,30,000/-, this Court is of the view that interest of justice will be served, if the condition is reduced to Rs.25,000/-. Accordingly, this Court directs the petitioner to deposit Rs.25,000/- instead of depositing of title deeds. The learned Magistrate is directed to re-deposit the said amount in fixed deposit account in any nationalised bank. The said amount can be disbursed with principal and interest either to the accused or to the de facto complainant as the case may be, at the time of culmination of the prosecution. The time limit for surrender is extended by two weeks from the date of receipt of a copy of this order.
