JUDGMENT
(The case has been heard through video conference) This Civil Revision Petition has been filed to set aside the order dated 06.11.2020, passed in Memo filed by the petitioner in F.C.O.P.No. 149 of 2016, on the file of the Family Court at Vellore. 2.Notice to the respondent is dispensed with. 1/4
3.The respondent in FCOP.No.149 of 2016 is the revision petitioner herein.
4.The respondent/husband herein has filed a petition in FCOP.No.149 of 2016, before the Sub-Court, Poonamalle, under Section 13(1)(ia) of the Hindu Marriage Act, for divorce on the ground of cruelty. During the pendency of the petition, the petitioner herein/wife had filed an application in I.A.No.260 of 2017, before this Court and the same was allowed on 22.06.2017. Apart from that, the wife had filed a maintenance case in F.C.M.C.No.28 of 2015, before this Court and the same was ordered on 28.02.2019 and the respondent herein/husband did not comply with the said orders. Since, there was a huge arrears of Rs.7,00,000/- for payment of interim maintenance, for enforcement of interim maintenance order, the revision petitioner/wife has filed the present Memo for joint hearing of CMP.No.20 of 2020 in C.M.P.No.463 of 2019 in F.C.M.C.No.
28 of 2015 and F.C.O.P.No.149 of 2016 and the said Memo was rejected by the Family Court, Vellore, due to the pendency of F.C.O.P.No.149 of 2016. 5.
dignified manner, directs the Family Court, Vellore to take up CMP.No.20 of 2020 in C.M.P.No.463 of 2019 in F.C.M.C.No.28 of 2015 and F.C.O.P.No.149 of 2016, on the same day and to dispose of it by a separate order.
6.With the above direction, this Civil Revision Petition stands disposed of. Consequently, connected miscellaneous petition is closed. No costs.
