ORDER

The petitioners has filed this petition seeking a direction to the Special Court for Trial of Cases under SC/ST (POA) Act cases, Tiruppur District to consider the petitioners' application on the same day of their surrender in connection with Crime No.21 of 2026 on the file of the second respondent police.

2. The case of the prosecution is that the de facto complaint and others were employed in a farm and were staying therein. On the night of 27.01.2026, the petitioners along other persons entered the farm using a JCB vehicle and an Pickup vehicle and caused damage to the property. When the de facto complaint and others attempted to prevent the same, they were assaulted and abused by referring to their caste name.

3. The Government Advocate (Crl. Side) submitted that the third petitioner is not an accused in this case.

4. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in the present case.

5. In view of the above factual position, there shall be a direction to the Special Court for Trial of Cases under SC/ST (POA) Act cases, Tiruppur District to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No. 21 of 2026 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
