ORDER
The petitioner, who was arrested and remanded to judicial custody on 07.04.2025 pursuant to the non-bailable warrant issued in S.C.No.148 of 2022 on the file of the XVIII Additional Sessions Court, Chennai, in connection with Crime No.213 of 2016 registered for the offences punishable under Sections 147, 148, 302 r/w 120(B), 34 of IPC, seeks bail. 2.Pursuant to the order passed by this Court on 30.06.2025, the learned Government Advocate submitted that the petitioner has got a long criminal history. The petitioner has been previously involved in a murder case in S.C.No.481 of 2025, which is pending before the learned III Additional District Judge, Tiruvallur. In that case, petitioner is arrayed as A1 and he murdered one Pandian. Apart from this case, he has got few other cases. He further submitted that four times the petitioner had suffered NBW, thereafter lastly NBW issued on 19.02.2025 and executed on 07.04.2025. In this case, 2/6
there are totally 11 accused and NBW was pending against A3 and now NBW executed and A3 was also produced before the Court. All the accused are now appearing in S.C.No.148 of 2022 and the trial itself can be completed within a stipulated period. The petitioner's contention that his wife is an Advocate, hence, false cases are foisted against him is without any substance. In the year 2024, the petitioner is involved in 5 cases, in the year 2023, involved in 3 cases and he has also detained under Act 14 of 1982 on three occasions. Thus the petitioner has been indulging in criminal activities continuously. The petitioner has got nothing to do with the petitioner's wife being an Advocate. Hence, strongly opposed for granting bail to the petitioner. 3.The learned counsel for petitioner submitted that in this case allegations have been made against the petitioner without any substance. Even in this case there are 27 witnesses, of which, 13 witnesses examined and the major witnesses not supported the case of the prosecution. The left 3/6
over 14 witnesses are primarily official witnesses. In the event of nonconsideration of bail, a direction can be given to the trial Court to complete the trial within a stipulated period.
4.The learned Government Advocate submitted that the petitioner, apart from the above case, has facing yet another murder case in S.C.No.481 of 2024. Steps have been taken and that case is also not progressing due to alternate absence of the accused in this case. The police are taking appropriate steps to remand the petitioner in S.C.No.481 of 2024. In any event, the remaining witnesses would be produced in this case without delay. 5.Considering the submissions made on either side and the nature of offence, this Court is not inclined to entertain this bail petition and the same is dismissed.

6.In view of the witnesses being produced without delay, the trial Court is directed to proceed with the trial as expeditiously as possible considering that the petitioner is in confinement.
