ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.12.2023 for the alleged offence punishable under Section 8(c) read with Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, in Crime No.354 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that while the respondent police were on patrol duty, they conducted a search and found the petitioner in possession of 40 kgs of Ganja. Pursuant to the investigation, the petitioner was arrested and remanded in judicial custody. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the above-said case. He further submits that the petitioner has been in continuous judicial custody since 05.12.2023.

4. The learned Government Counsel (Criminal Side) appearing for the respondent police vehemently opposes the grant of bail. He reiterates the case of the prosecution and submits that the contraband seized from the petitioner is a commercial quantity. He further submits that the investigation has been completed, the charge sheet has been filed, and the case is now pending trial in Spl.C.C.No.135 of 2024 on the file of the Special Judge for EC and NDPS Act Cases, Salem. He argues that given the nature and quantity of the contraband, the petitioner should not be granted bail.

5. Considering the facts and circumstances of the case, this Court takes note of the gravity of the allegations involving the possession of a commercial

quantity of Ganja, which attracts the statutory bar under Section 37 of the NDPS Act. Since the investigation has been completed, the charge sheet has been filed, and the case is now pending as Spl.C.C.No.135 of 2024 on the file of the Special Judge for EC and NDPS Act Cases, Salem, this Court is of the view that releasing the petitioner at this stage would not be appropriate. Therefore, this Court is not inclined to grant bail to the petitioner.
