Crl.O.P.No.16337 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Pasupathi Pandian, who was arrested and remanded to judicial custody on 11.06.2023 for the offences punishable under Sections 341, 294(b), 323, 363 and 506(i) of IPC in Crime No.100 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Petitioner is in Judicial Custody from 11.06.2023. He further submitted that, co-accused was granted bail. Thus, he seeks bail to the petitioner.

3. The learned Government Advocate (Crl. Side) submitted that, one Balakrishnan is working in Singapore and the defacto complainant is working under him. As per the instruction of Balakrishnan, on 13.05.2023 at about 09.00.p.m., defacto complainant received a sum of Rs.30 lakhs from one Nawaz, shop owner of China Bazar. While he was returning in his two wheeler, one person in police 1/3

uniform waylaid and kidnapped him to Armed Force Ground at Egmore and taken the money from him and escaped from the scene of occurrence. He further submitted that, petitioner is the one who engaged A1 and A3 for committing the crime. Petitioner received Rs.7 lakhs as his share. He further submitted that, out of 30 lakhs, so far 23 lakhs has been recovered. Investigation is pending.

Considering the gravity of the offence committed by the accused and having regard to the fact that, still certain amount is not yet recovered and also the fact that petitioner is the one who engaged 1st and 3rd accused for committing the offence and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
