The Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of certiorari calling for the records in C.M.A.No.27 of 2003 on the file of the learned Principal District Judge of Erode District at Erode the first respondent herein and quash the Judgment and Decree dated 08.06.2005 passed therein through which the first respondent has granted interest at the rate of 6% only per annum from 13.12.2002 till the date of realisation.

ORDER

The learned counsel for the petitioner submitted that by letter dated 09.04.2012, it has been informed by the Erode District General Co-operative Bank Limited that the Shanmugavadivu has paid the award amount along with interest and therefore, nothing survives for adjudication of the writ petition. Further, the learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition.

2. In view of the above, the Writ Petition is dismissed as withdrawn. No Costs.
