This Criminal Original Petition has been filed seeking a direction to the 2nd respondent not to harass the petitioner under the guise of enquiry.

2. The petitioner is the daughter of the 3rd respondent. The 3rd respondent/mother had earlier settled the property in favour of the petitioner. Thereafter, the 3rd respondent filed a petition before the DRO under the Senior Citizens Act seeking cancellation of the settlement deed, which came to be dismissed. Aggrieved by the same, she preferred an appeal before the District Collector, which was also dismissed. In the meanwhile, the petitioner entered into a sale agreement with a third party and a civil suit was filed for execution of the sale deed. The 3rd respondent appeared before the Civil Court, executed the sale deed and also received the sale consideration. Thereafter, suppressing all these material facts, she lodged the present complaint.

3. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 and 2. 2/4

4. In view of the above, the dispute is purely civil in nature between the mother and daughter. However, if the presence of the petitioner is required for the purpose of enquiry, the respondent police shall conduct the enquiry in accordance with law. Since the petitioner is an orthodox Muslim woman, the respondent police are directed to depute a woman police officer to conduct the enquiry.

5. With the above directions, this Criminal Original Petition is disposed of.
