C.M.P.No.14905 of 2022 and A.S.No.407 of 2022 S.SOUNTHAR, J.

The leaned counsel for the petitioner reported that the conditional order dated 14.09.2022 has been complied with. He also produced E-chellan dated 20.10.2022 in support of the said condition.

2. The learned counsel for the respondent requested this Court to permit them to withdraw the amount deposited by the petitioner.

3. According to the petitioner/defendant he borrowed only a sum of Rs.1,20,000/- from the respondent. He paid Rs.79,122/-. Even as per the admitted averment of the petitioner he has to pay Rs.52,748/- to the respondent/plaintiff. In view of the same respondent are permitted to withdraw Rs.2 lakhs out of Rs.4,70,000/- deposited by the petitioner to the credit of O.S.No.458 of 2014. Interim stay already granted by this Court is made absolute. Both the counsel for the petitioner and respondent requested this Court to refer the matter to the mediation center to explore the possibility of settlement.
