Civil Revision Petition filed under Article 227 of Constitution of India, to direct the learned Principal District Judge, Salem to expedite and dispose of the I.A.No.171 of 2016 in O.S.No.317 of 2009 within the time frame and allow the above CRP.

ORDER

The defendant in a partition suit is the revision petitioner, seeking expeditious disposal of the final decree application pending in I.A.No.171 of 2016 in O.S.No.317 of 2009, has come up with this Civil Revision petition.

2. It is seen that the subsequent to the judgment and decree dated 29.10.2023 that was passed in O.S.No.317 of 2009, a final decree application has been taken out in I.A.No.171 of 2016. It is also brought to my notice that, in the final decree proceedings, an Advocate Commissioner has also been appointed. However, there has been no progress for the last almost ten years.

3. Considering that the suit is for partition and the same is pending from 2009 onwards, this Civil Revision Petition is allowed and the Principal District Court, Salem is directed to expedite the final decree application and after providing fair opportunity to all the parties, the final Page No.2 of 4

decree shall be passed on merits and in accordance with law on or before 31.01.2026. No costs.
