This writ petition has been filed seeking issuance of a writ of mandamus directing respondents to demarcate the schedule mentioned property of petitioner comprised in Survey No.245/1A1B vide Patta No.2133.
2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that he has purchased the schedule mentioned property comprised in Survey No.245/1 measuring an extent of
4 acres situated at No.37, Pottur Village, Saidapet Taluk, Chengalpattu District from one Aruna Shrivastava vide sale deed dated 14.09.2006 registered as Document No.7838 of 2006 on the file of Sub Registrar, Redhills. Petitioner obtained patta in his name vide Patta No.2133 in respect of the property comprised in Survey No.245/1A1B which was sub-divided from Survey No.245/1 in the year 2010. An application was sumitted before the respondents on 29.01.2010 to demarcate the schedule mentioned property. Since the same was not considered, the present writ petition has been filed.
4. At the outset, it is submitted by Mr.A.Selvendran, learned Special Government Pleader appearing for respondents that they will consider the petitioner's application within a period of eight weeks, which was agreed to by learned counsel for petitioner.
5. In view thereof, this Writ Petition stands disposed of with a direction to the concerned respondent to consider petitioner's application
dated 29.01.2010 with respect to demarcation of the property and pass appropriate orders after putting petitioner, adjacent land owners and any other interested parties / rival claimants, if any, on notice within a period of eight weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law. No costs.
