The Writ petition has been filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the respondents to remove the petitioner's name from the history sheet opened in my name in 14/HS/R8/2013 on the file of the 3rd respondent.

ORDER

The petitioner sent a representation dated 24.09.2021 to the Commissioner of Police and Joint Commissioner of Police to remove his name from the History Sheet. The petitioner is shown as History Sheeter in HS No.14 of 2013.

2.The contention of the learned counsel for the petitioner is that the petitioner has got no previous case and there is nothing to show that the petitioner is a history sheeter. Since

the petitioner had questioned the Sub Inspector of police, the petitioner was projected as a history sheeter and his name included in the same.

3.The learned Additional Public Prosecutor submits that it is for the Deputy Commissioner of Police to pass appropriate orders in the case of the petitioner, but the petitioner had sent representations to the Commissioner of Police and to the Joint Commissioner of Police and no representation has been sent to the Deputy Commissioner of Police T.Nagar. If the petitioner submits a representation to the Deputy Commissioner of Police, the same would be considered.

4.The counsel for the petitioner submits that a copy of the representation will be forwarded by the petitioner to the Deputy Commissioner of Police immediately.

5.Considering the submissions, the Deputy Commissioner of Police, T.Nagar, on receipt of the representation of the petitioner, is directed to consider and dispose of the same within a period of three months from the date of receipt of the representation.

6.With the abovesaid direction, the writ petition is disposed of. No costs.
