..Respondent(s) Petition filed under Section 528 of BNSS, 2023 to relax the condition No. (iii) i.e., The petitioner shall appeal before the trial Court on every Monday at 10.30 a.m until the disposal of the Criminal Appeal imposed upon the petitioner vide order in Crl.M.P.No.22177 of 2025 dated 25.11.2025 in Crl.A.No.1404 of 2024 and thus render justice.

Order (Order of the Court was made by Dr.Anita Sumanth J.) This is a petition seeking relaxation of the conditions imposed under suspension order dated 25.11.2025.

2. We have heard Mr.V.Rajamohan, learned counsel for petitioner and Mr.A.Amarnath, learned counsel for Government of Tamil Nadu (Criminal Side) for respondent.

3. There is no dispute on the position that the petitioner has been complying with the conditions thus far including para (iii) which requires appearance on every Monday at 10.30 am until the disposal of the appeal or in the alternate to seek dispensation of their appearance.

4. Mr.A.Amarnath, learned Counsel for Government of Tamil Nadu (Criminal Side), confirms the aforesaid position.

5. In light of the aforesaid, condition (iii) relating to weekly appearance is relaxed and stands modified to read that 'the petitioner shall appear on the first working day of every Month before the trial Court or in the alternate shall make arrangements to file application under Section 317 Cr PC and appear before the trial Court on any other day in lieu of the date on which he was absent'.

6. This petition is ordered accordingly.
