ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.04.2025 for the offences punishable under Sections 103, 305(a), 238, 329(4) of BNS, 2023 in Crime No.161 of 2025, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the de-facto complainant's mother, aged about 71 years, was died in a suspicious manner at her home. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner was a tenant and the deceased is a landlady, who died in a mysterious circumstance by hanging. For her death, the petitioner and his friend on suspicion, made as accused. In this case some recovery also made. The petitioner is in prison for 73 days. Hence, prayed for granting bail to the petitioner.

4.The learned Government Advocate strongly opposed for granting bail to the petitioner stating that the petitioner was a tenant under the deceased, who is a single lady, aged about 71 years. A2 in this case often used to visit A1/petitioner, which was objected by the deceased and there was also some tenancy dispute. On the advice of A2, the petitioner and A2 joined together assaulted the deceased and she was done to death. Thereafter they hanged the body as though she committed suicide by hanging. After committing murder of the deceased, they had taken away 3 sovereigns of gold jewels from the deceased. On the arrest of the accused, the jewels were recovered. The post-mortem and medical records confirms that there were several injuries on the deceased and except for the petitioner and other accused no one in the house at that point of time and hence, recovery confirms the petitioner's active involvement in the offence. 3/4

5. Considering the grave nature of offence, this Court is not inclined to grant bail to the petitioner and hence, the criminal original petition is dismissed.
