Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the first respondent to consider the petitioner representation dated 09.02.2017 for taking into account of half of his service rendered as casual mazdoor from 21.07.1999 to 15.06.2013 along with his regular service to reckon the total qualifying service for pensionary benefits and other benefits and pass suitable orders.

Heard Mr.J. Rajmohan, the learned counsel appearing for the petitioner and Mrs.R. Janaki, the learned Additional Government Pleader, who accepts notice on behalf of the respondents.

The petitioner has come to this Court by way of this Writ Petition seeking a writ of mandamus, directing the first respondent to consider his representation dated 09.02.2017 for taking into account half of his service rendered as casual mazdoor from 21.07.1999 to 15.06.2013 along with his regular service, to reckon the total qualifying service for pensionary benefits and other benefits.

The learned Additional Government Pleader for the respondents submits that, if such representation is pending, the respondents shall have no objection to consider the same, but, in accordance with law within the period, as directed by this Court.

Considering the nature of relief sought for by the petitioner and after hearing the learned counsel for the parties, this Court, without expressing any opinion with regard to the merits of the case as projected by the petitioner, either in this Writ Petition or representation, disposes of the Writ Petition, at the stage of admission, with a direction to the first respondent to take an informed and considered decision on the representation of the petitioner, dated 09.02.2017, if not already taken, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, if there is no other legal impediment and communicate the decision taken to the petitioner. No costs.
