The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1)(b), 4(1)(g) and 4(1)(aaa) of TN Prohibition Act, in Crime No.208 of 2022, seek anticipatory bail.

2. The case of the prosecution is that, when the respondent police were on their patrol, they saw some persons preparing arrack by using stove. On seeing the respondent police, they ran away from the scene of occurrence and on investigation, the respondent police found 700 liters of Wash and 120 liters of I.D. Arrack. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they are no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.side) appearing for the respondent submit that the petitioners are arrayed as A1 and A2 and they are having 14 and 10 previous cases pending against them respectively. Hence, he

vehemently opposed to grant anticipatory bail to the petitioners.

5. Taking into consideration the allegations and also the bad antecedent of the petitioners and the fact that the custodial interrogation of the petitioners is essential, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition is dismissed. 17.08.2022 mpl
