ORDER

The Transfer Civil Miscellaneous Petition has been filed by the petitioner / wife seeking transfer of HMOP No. 511 of 2024 filed by respondent pending on the file of Subordinate Court, Ambattur to Subordinate Court, Alandur.

Heard the arguments of learned counsel on either side. 3.

It is the case of the petitioner that the respondent / husband filed HMOP No. 511 of 2024 seeking declaration of marriage between the petitioner and the respondent as nullity. 4.

According to petitioner, she is residing at Kovilambakkam within the jurisdiction limits of Subordinate Court, Alandur and she finds it very difficulty in undertaking travel from Kovilambakkam to Ambattur, which is 76 kms away from her residence.

Learned counsel for the respondent vehemently opposed the prayer for transfer on the ground that the petitioner herein filed the instant transfer petition only to harass the respondent. 6.

It is settled law that in cases of matrimonial dispute, the preference shall be given to the convenience of wife. 7.

In the case on hand, the petitioner / wife is residing at Kovilambakkam, within the territorial limits of Subordinate Court, 2/4

Alandur and she expressed difficulty in undertaking travel to Ambattur for the purpose of attending the court hearings. Hence, taking into consideration the convenience of petitioner / wife, this Court is inclined to transfer the above transfer petition as prayed for.

Accordingly, the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.511 of 2024 pending on the file of the Subordinate Court, Ambattur is withdrawn and transferred to the file of the Subordinate Court, Alandur.
