O R D E R

This Contempt Petition has been filed to punish the respondent for the willful and deliberate dis-obeyance of the order passed by this Court dated 04.03.2025 passed in W.P.No.2436 of 2024, thereby directing the respondent to remove thorny trees on the petitioner's land, after issuance of notice to the petitioner and the counter party if any.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the respondent filed an affidavit before this Court and avered that on 11.08.2025, the District Revenue Officer, Kallakurichi issued its proceedings and stated that the land comprised in S.No.492/7, situated in Vellore Village, Ulundurpettai Taluk, Kallakurichi District measuring an extent of 0.76.0 hectares stands in the name of one Joseph Sellaiah as per the Updated Date Register (UDR). Further, on receipt of the representation seeking subdivision of an extent of 0.09.10 hectares, which is being used as a pathway for public access. Upon detailed field inspection and enquiry conducted by the Assistant Collector, Thirukovilur Division. After submitting an enquiry report and stating that the said portion of land 2/5

has been in continuous and uninterrupted use as a public access pathway for over 70 years, providing vital access to the residents of Govindarajapattinam Village.

3. He would further submit that after purchase of the subject land by the petitioner, he refused to relinquish or dedicate the land for public use unless compensation is provided. Therefore, it is ordered that the land comprised in S.No.492/7 be duly subdivided, earmarking an extent of 0.09.10 hectares as a public pathway. Accordingly, the Revenue Officials are directed to take necessary action to update and correct the Village and Taluk accounts, by effecting mutation in 'A' Register, classifying the subdivided portion as "pathway" (public road), and to ensure that the changes are uploaded and recorded in the computerized revenue records in accordance with the established procedure.

4. In view of the above, no contempt is made against the respondent. Accordingly, this Contempt Petition is dismissed. No costs. 3/5
