WMP No.20688 of 2023 in W.P.No.11849 of 2019 C.V.KARTHIKEYAN,J., The Writ Petition has been filed by the petitioner seeking disbursement of retirement benefits and such other monetary benefits, which had accrued consequent to the services rendered by her husband R.Ramamoorthy, who died while in service as Junior Assistant in the Treasuries and Accounts Department.

2. In the counter affidavit filed on behalf of the third respondent District Treasury Officer, it is stated that the services of R.Ramamoorthy have not been regularised.

3. Hence, the present Miscellaneous Petition has been filed seeking, in addition to the relief sought for in the Writ Petition, also the relief of declaration that the services of her husband should also be regularised.

4. Learned Special Government Pleader pointed out to the counter affidavit filed on behalf of the third respondent that the husband of the petitioner was appointed as Junior Assistant on compassionate grounds, since his father Raju who was working as Office Assistant in Sub-Treasury at Salem died while in service on 15.11.1995.

5. It had also been stated that when the certificates of the petitioner's husband were forwarded for verification, it was found that the mark sheet was forged and thereafter, after conducting enquiry and also after filing a first information report, the services of the husband of the petitioner were terminated.

6. Now the petitioner also seeks regularisation of his service. Hence, it is appropriate that all aspects including regularisation and disbursement of terminal benefits are argued in one stretch in order to to enable this Court to pass a common order. Therefore, even though learned Special Government Pleader has pointed out the above facts, the Miscellaneous Petition stands allowed.

7. List the Writ Petition on 05.09.2023.
