PRAYER : Criminal Original Petition is filed under Section 439(1)(b) of Criminal Procedure Code praying to modify the condition imposed by the learned Judicial Magistrate, Palladam in CMP No.1038 of 2020 dated 13.07.2020.

O R D E R

(The case has been heard through video conference) This petition has been filed to modify the condition imposed in CMP No.1038 of 2020 dated 13.07.2020.

2. Earlier, bail was granted under Section 167(2) Cr.P.C by the learned Judicial Magistrate, Palladam with a condition to produce the solvency certificate for a sum of Rs.1,00,000/- and the present petition has been filed to modify the said condition.

3. The learned counsel for the petitioner would submit that the petitioner is not able to fulfill the said condition and he is still in jail eventhough bail was granted on 13.07.2020. Hence, he prays to modify the above condition.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that totally there are 3 accused. Totally 96 lakhs have to be recovered from the accused persons. Other two accused, namely A1 and A2 were also arrested at Gurugram, Haryana, for some other offences and it is not a case for modification of the condition and hence, he strongly opposed to modify the condition. 2/4

5. Considering the facts and circumstances of the case, this Court is not inclined to modify the condition imposed and accordingly, this Criminal Original Petition is dismissed. 06.01.2021 mrp To
