Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 5 to order for payment of compensation of Rs.70,00,000/- and also additionally grant child higher Education Cover to the petitioner together with eligible interest.

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.
2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondents 1 to 5 to order for payment of compensation of Rs.70,00,000/- and also additionally grant child higher Education Cover to the petitioner together with eligible interest.
3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the petitioner's husband was appointed as Police Constable, Helper in the Police Department on 19.07.1993. It is the submission of the petitioner that the petitioner's husband and other police personnels were deputed to Pune to bring ammunition and that the vehicle was driven by the petitioner's husband-Mr.David. It is the contention of the petitioner that the vehicle driven by the petitioner's husband met with an accident. Though the other personnels were got injured, the petitioner's husband-Mr.David died on 14.03.2020. In pursuance thereof, the Pondicherry Government has given Rs.5,00,000/- as compensation. However, it is the contention of the petitioner that in view of the Insurance Scheme of the petitioner's husband, the petitioner is eligible to get compensation of Rs.70,00,000/-. In this connection, the petitioner had sent a representation to the 1st respondent on 07.11.2023 and such representation is pending with them.
5. At this juncture, the learned Additional Government Pleader (Pondicherry) appearing for the respondents 1 to 3 and 5 would submit that they will consider the petitioner's representation according to it's own merits and in accordance with law, within a reasonable time. 3/6

In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the 1st respondent to consider the petitioner's representation dated 07.11.2023 with the aid of Home Secretary, Government of Puducherry and before taking any decision, the 1st respondent is directed to afford an opportunity to the 4th respondent.
7. The above said exercise is directed to be completed within a period of eight weeks from the date of receipt of copy of this order.
8. With the above direction, the Writ Petition is disposed of. No costs. Consequently, the connected writ miscellaneous petition is closed. 29.07.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
