Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to survey the land in 418/3 and fix the boundary to the extent of 4.16 acres as per partition deed dated 22.10.1947 being Document No.1233/1947 and subsequent sale deed dated 18.6.1974 being document No.644 of 1974 and document No.279 of 1976 dated 7.6.1976 and fix the boundary for car track 1/6

at Sirukalanji villgae, Sennimalai Panchayat union, Voothukuli, Erode District and consequently direct the respondents to change the same in all revenue records of the respondents by considering the petitioner representation dated 21.04.2025 within a time frame to be fixed by this Court.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to survey the land in 418/3 and fix the boundary to the extent of 4.16 acres as per partition deed dated 22.10.1947 being Document No.1233/1947 and subsequent sale deed dated 18.6.1974 being document No.644 of 1974 and document No.279 of 1976 dated 7.6.1976 and to fix the boundary for car track at Sirukalanji villgae, Sennimalai Panchayat union, Voothukuli, Erode District and consequently to direct the respondents to change the same in all revenue records of the respondents by considering the petitioner representation dated 21.04.2025 within a time frame to be fixed by this Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. It is seen that in order to survey the aforementioned land, the petitioner submitted an application before the respondents. So far the respondents did not take any steps to survey and demarcate the aforementioned lands. Hence, this writ petition.

In view of the above, the fourth respondent is directed to survey the aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if there are, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor. 3/6

5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
