ORDER

The present writ petition has been filed to call for the records in respect of the impugned order issued by the 1st respondent vide his proceedings in File No.NCTE/2025/SRC/PAR/ORDER/APSO7280/dated 21.05.2025 and quash the same and direct the 1st respondent to give a continuation of recognition order to the petitioner's B.Ed., College for the academic year 2025-2026..

The learned counsel for the petitioner would submit that for the flimsy reason of non-submission of the Performance Assessment Report for the academic year 2021-22, the respondents have de-recognized the petitioner's institution with effect from 2024-2025, in which, the petitioner and also the students and staffs of that College was seriously prejudiced. 2/6

At this juncture, the learned Standing Counsel appearing for the first respondent would submit that the petitioner has got appellate remedy under Section 18 of the National Council for Teacher Education Act, 1993 (herein after referred as "NCTE Act"). Therefore, approaching of the Writ Court by the petitioner is not maintainable.

4. I have given my anxious consideration of either side submissions.

As rightly contended by the learned Standing Counsel for the first respondent, the petitioner has got appellate remedy under Section 18 of the NCTE Act, therefore, this Court do not want to interfere with the impugned order. However, this Court gives liberty to the petitioner to prefer an appeal under Section 18 of the NCTE Act, before the Appellate Authority, within a period of two (2) weeks from the date of receipt of a copy of this order. On such filing of an appeal, the Appellate Authority is directed to dispose of the appeal within a period of eight (8) weeks, thereafter. Until then, there shall be an order of interim stay of the impugned order, dated 21.05.2025.

6. With the above observation, the Writ Petition stands disposed of. No 3/6
