ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence punishable under Section 341, 294(b), 323, 392, 506(II), 397 of IPC, in Crime No.1339 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant and thereby robbed Rs.2,500/- at knife point. Hence the Law Enforcing Agency registered a case against the petitioner.
3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any such offence as alleged by the prosecution and she has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl.Side) submits that the robbed property has not yet recovered. He further submits that the petitioner is an History Sheeter in H.S.No.47 of 2021 and there are four previous cases similar in nature pending against the petitioner. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering the nature of offence committed by the petitioner and also considering that there are four previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this petition is dismissed.
