Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the second respondent to consider the online representation of the petitioner in Application No.2024/0105/33/498896 dated 11.07.2024 and further representation dated 06.01.2025 forwarded by the first respondent to second respondent in his letter No.C.Pa.No.A4/001/2025 dated 6.1.2025, seeking for sub-division and issue for a separate patta in her name and in the names of her children Lakshmipriya R.S. And son Ananthakrishnan R.S., in respect of Natham house site in S.Nos.62/4A1, 52/11 and 149/9, measuring an extent of 1983.75 sq.ft. (184.30 sq.m) in Manalurpettai Village, Vanapuram Taluk, Kallakurichi District.

ORDER
By consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition has been filed praying for a writ of mandamus to direct the second respondent to consider the online application of the petitioner dated 11.07.2024 for surveying the property comprised in S.Nos.62/4A1, 52/11 and 149/9, measuring to an extent of 1983.75 sq.ft. (184.30 sq.m) in Manalurpettai Village, Vanapuram Taluk, Kallakurichi District.
3. It is submitted by Mr.AE.Ravichandran, learned counsel for the petitioner that the petitioner claims to have lawful inherited the above property on the death of her husband, S.Rajendran. A settlement deed was executed by petitioner's mother vide Document No.2792 of 2014 dated 26.12.2014 bequeathing the subject property in his favour. It is submitted by the learned counsel for the petitioner that the patta and other revenue records stand in the name of her mother-in-law and one Mohan. The petitioner had taken out an online application on 23.11.2023, seeking transfer of patta in the name of the petitioner and the children, who are the Page No.2 of 6
legal heirs of Late S.Rajendran.

The petitioner had also sought survey of the subject property earlier, however, vide proceedings dated 19.03.2024, the request was rejected on the premise that the field is covered with thorny bushes and it is to be cleared. It is submitted by the learned counsel for the petitioner that the petitioner had subsequently cleared the property and had taken out yet another application for survey on 11.07.2024.
5. The learned counsel for the petitioner would also submit that if there are thorny bushes causing any hindrance in carrying out the survey, they will ensure that the same is cleared to make it convenient for the Authorities to carry out the survey.

Mr.A.Selvendran, learned Special Government Pleader for the respondents would submit that if the land is cleared off thorny bushes, they would carry out the survey and would also consider the petitioner's request for issuance of patta, on its own merits and in accordance with law, after giving prior notice to the petitioner, adjacent land owners and/or any other interested parties, including Page No.3 of 6
rival claimants if any, within a period of twelve weeks from the date of receipt of the uploaded copy of the order. The same is accepted to by the learned counsel for the petitioner.
7. Recording the submissions made by the learned Special Government Pleader, the present writ petition stands disposed of. It is made clear that this Court has not expressed any views with regard to the merits of the matter and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
