G. CHANDRASEKHARAN, J., The petitioner who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 4(1)(a) and 4(1A)(ii) of the TamilNadu Prohibition Act in Crime No.179 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons were found in possession of 5 litters Arrack and 20 bottles of 90 ml of Bangalore Rum. Hence, the complaint.

3. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in a case registered for the offence under Sections 4(1)(a) and 4(1A)(ii) of the TamilNadu Prohibition Act in Crime No.179 of 2023. Apprehending arrest, this petition is filed.

4. In reply, the learned Government Advocate (Crl. Side) submitted that, the petitioner and the co-accused has been found with illegal possession of following liquor bottles on 25.06.2023: (i) 250ml of Arrack (20 packets), totally 5 litters. (ii) 90 ml of Bangalore Rum (20 bottles)

5. Further, he submitted that there are nine similar cases pending against him in Crime Nos.179 of 2023, 288, 484, 337, 312 and 43 of 2022, 418 and 74 of 2021, 230 of 2014. Hence, he opposed for grant of bail to the petitioner.

6. Considering the fact that the petitioner is a habitual offender and having nine previous cases and also the fact that the investigation is not completed, this Court is not inclined to grant anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 31.07.2023 nsa
