This Civil Miscellaneous Petition has been filed seeking to condone the delay of 49 days in filing the appeal against the award made in M.C.O.P.No.238 of 2018, dated 20.09.2022, on the file of the Motor Accident Claims Tribunal, Special Sub Court, Krishnagiri.

2.Private notice that was sent to the 1st respondent has been returned with an endorsement as 'party refused'. Hence, there shall be a deemed service for the 1st respondent. Already the notice to 2nd respondent has been dispensed with.

3.Heard the learned counsel for the petitioner and perused the records.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 49 days is condoned.
