The instant writ petition has been filed challenging the order dated 26.05.2025 passed by the second respondent.

The learned counsel for the petitioner would submit that though the second respondent had recruited candidates, vide notification dated 16.02.2023, still there are wait list candidates who are yet to be considered for appointment. But without appointing the wait list candidates, the second respondent issued another impugned notification in contravention to law and prodecure. According to the learned counsel for the petitioner, the wait list candidates of the previous notification had to be given appointment first before going for fresh recruitment. Therefore, contended that unless the wait listed candidates are given appointments, the second respondent cannot have any fresh recruitment.

Though the submission of the learned counsel for the petitioner appears to be attractive, it is a well-settled principle of law that whenever a fresh notification is issued, the wait list automatically get lapsed. Apart from that, keeping a wait list for more than three years would also be an anathema to the appointment proceedings. Hence, this Court does not find any merit in the present writ petition.

4. Accordingly, this Writ Petition is disposed of. Consequently, the connected Miscellaneous Petitions are closed. No costs. 20.06.2025 kv Index : Yes/No Speaking order /Non Speaking Order To
