CR. NO.7/2021 Petition praying that in the circumstances stated therein the High Court will be pleased to (i) Pass an order relaxing the condition mentioned in Paragraph No.13(d) the petitioner shall report before respondent police daily at 10.30 am till the issue is settled imposed in Crl.O.P.No.15700 of 2021 dated 07.09.2021. [IN CRL.M.P.No.10433 OF 2021] (ii) Pass an order relaxing the condition imposed in Crl.O.P.Nos.15698 & 15694 of 2021 dated 07.09.2021 in paragraph No.12 that The Petitioner is directed to appear before the Respondent police every Monday till the issue is settled and in Paragraph Nos.13(d) & 13(C) the petitioner shall report before respondent police daily at 10.30 am till the issue is settled. [In Crl.M.P.Nos.10434 & 10435 of 2021]
Order: This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.T.VENKATESH KUMAR, Advocate for the Petitioner [IN ALL THE PETITIONS] and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) [IN ALL THE PETITIONS] on behalf of the Respondent the court made the following order:- The Petitioners have filed this petition seeking to relax the conditions imposed by this Court in Crl.O.P.Nos.15694, 15698 & 15700 of 2021 for the offences punishable under Sections 409 & 420 of IPC, in Crime No.7 of 2021, while granting anticipatory bail. 2.Heard the learned Counsel appearing for the petitioners as well as the learned Government Advocate.
3.The learned Government Advocate submitted that the petitioners are complying with the condition regularly.
4.Considering the facts and circumstances of the case, the condition already imposed by this Court is relaxed insofar as the petitioners in Crl.MP.Nos.10434 & 10435 of 2021 are concerned and the petitioners [A3, A5 & A6] are directed to appear before the respondent police as and when required for interrogation on receipt of the summons. Insofar as the petitioner [A2] in Crl.MP.No.10433 of 2021 is concerned, he shall appear before the respondent police every Monday at 10.30 AM till the amount is disbursed to the victim.
5. In the result, the petitions in Crl.MP.Nos.10434 & 10435 of 2021 are ordered and the petition in Crl.MP.No.10433 of 2021 stands modified.
