JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) Disputed facts cannot be adjudicated in writ proceedings under Article 226 of the Constitution of India.

2. In the present case, a writ of mandamus has been instituted seeking a direction to the respondents to pay Rs.10,00,000/- as compensation with a monthly pension of Rs.10,000/-.

3. The complaint of the appellant/writ petitioner is that he submitted his original documents before the Superintendent of Police and they have not returned the original documents. Therefore, the appellant has set out a claim for compensation.

4. Learned Government Counsel would submit that there is no proof to establish that the appellant submitted his original documents.

5. Pertinently, the Writ Court in Paragraph No.4 of the impugned order made a finding that there is no proof to show that the appellant submitted the original documents while applying for appointment on compassionate

grounds. That apart, the application for compassionate appointment was rejected in the year 1998. The petitioner slept over the matter and, after a lapse of 15 years, the petitioner filed a writ petition seeking compensation. The person who slept over his right, if any exists, cannot wake up one fine morning and knock on the doors of the Court.

6. Thus, this Court does not find any infirmity in the order dated 12.01.2024 passed in WP No.832 of 2024 and the same stands confirmed. Accordingly, the writ appeal stands dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.)
