The instant writ petition has been filed with a prayer for issuing a mandamus to direct the third respondent to appoint the petitioner in the Police Department on compassionate grounds in order to protect his family livelihood by considering the representation of the petitioner dated 19.08.2024.
2. The learned counsel for the petitioner would submit that he has given an application for compassionate appointment. According to the petitioner prior to his father demise, his mother had already passed away. At the time of his father's death, the petitioner was aged about 13 years, his brother was aged about 12 years. It is the further submission of the learned counsel for the petitioner that he was brought up by his grandmother, who is a daily labour. She would further submit that the petitioner has now secured degree in B.S.C., Computer Science. In view of his father's death in 2008 while was in service, the petitioner has sent various representations, the most 2/6
recent ones dated 19.08.2024 and 20.08.2024 to the District Collector and the third respondent, and such representations are still pending without any progress.

Per contra, the learned Government Advocate would vehemently contend that the petitioner's application for compassionate ground cannot be considered, as it contrary to the guidelines of the Government, and that the period provided in the guideline has lapsed on the date of his application. Hence, prayed to dismiss the instant Writ Petition.
4. I have given my anxious consideration to either side submissions.
5. Though there is a disputed fact between the petitioner and the respondents, the facts remains that the petitioner's representation is still pending with the third respondent. It is pertinent to mention that whenever any representation is received, it has to be considered by the authority in accordance with law.

In such view of the same, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 19.08.2024 and 20.08.2024, and pass orders on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above directions, this Writ Petition is disposed of. No costs.
