ORDER

This writ petition has been filed to direct the 4th and 5th respondents to return back the lands Situated at S.No. 176, Now R.S. No. 63/2, in Pachaiyangkuppam, Cuddalore, measuring about 32.38 cents which was never acquired by the 4th respondent and which is in possession of the 4th respondent.

The learned counsel for the petitioner would submit that in this case, out of total extent (4.40 Acre), the SIPCOT has acquired the land to the extent of 4.07 Acres, which belongs to petitioner's mother. The remaining 33 cents of land was not acquired by the SIPCOT. Hence, a representation was made before the Special Thasildhar to measure the subject land and identify the 33 cents of petitioner's land. Further, he would submit that the patta of the 33 cents of land stands in the name of the petitioner's mother. Hence, this petition.

3. In reply, the learned counsel for the official respondents would submit that the respondent will measure the property and identify the 33 cents of land, if it is available, and the same will be informed to the petitioner.

On the other hand, the learned counsel appearing for SIPCOT-4th respondent would submit that if any land over and above the acquired portion of 4.07 Acre is in their possession, the compensation for the said portion will be paid to the petitioner in accordance with law. On the other hand, if it is not utilised, the same will be handed over to the petitioner.

5. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

6. In the case on hand, there is no dispute on the aspect that out of total extent (4.40 Acre), the SIPCOT has acquired the land to the extent of 4.07 Acres, which belongs to petitioner's mother. The remaining 33 cents of land was not acquired by the SIPCOT and the patta of the said portion stands in the name of the petitioner's mother.

7. In such case, the 5th respondent is directed to conduct survey and identify the petitioner's land to an extent of 33 cents. Thereafter, the status of the said extent of land shall be found out and informed to the petitioner. If the land is not utilised by SIPCOT, the same shall be handed over to the petitioner. On the other hand, if it is already utilised, it is needless to state that the SIPCOT shall pay the compensation to the said land in accordance with law. The entire

exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order.

8. With the above directions, this writ petition is disposed of. No cost. Consequently, the connected miscellaneous petition is also closed.
