ORDER
This writ petition has been filed challenging the impugned communication dated 19.12.2024 issued by the 3rd respondent and for a consequential direction to the 3rd respondent to act upon the application submitted by the petitioner and to issue passport to the petitioner.

Heard M/s.T.Dharani, learned counsel for the petitioner and Mr.C.Veda Bagath Singh, learned Additional Government Pleader for 1st respondent and Mr.Leonard Arul Joseph Selvam, learned Government Advocate [Crl Side] for 2nd respondent and Mr.J.Rajesh, Central Government standing Counsel for 3rd respondent.

The learned Government Advocate appearing on behalf of the 2nd respondent submitted that an FIR has been registered in Crime No.261 of 2021 for offence under Section 294(b), 323, 506(i) of IPC and that the investigation is pending till date. The learned Government Advocate further submitted that the petitioner has been added as A1 in the FIR.

In the considered view of this Court, the mere registration of an FIR cannot be a ground to reject the issuance of passport to the petitioner. The criminal case at the stage of an FIR is not a "case pending" and therefore, there shall be a direction to the 3rd respondent to act upon the application submitted by the petitioner and issue the passport to the petitioner, if the petitioner has satisfied all the other requirements, within a period of four weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
