O R D E R

The Civil Revision Petition is filed challenging the order passed by the Court below dismissing the petition to set aside the exparte order passed against the revision petitioner/ 3rd defendant in O.S.No.390 of 2012 on the file of the Principal Subordinate Court, Tiruppur.

2. When the matter is taken up for hearing, the learned counsel for the respondents/plaintiffs submitted that subsequent to the order impugned, the matter had been settled between the parties and they want to record the compromise before the Court below. In view of the pendency of this revision and an interim order granted by this Court, they are not in a position to record the compromise. He also filed a Memo dated 01.11.2022 signed by all the respondents and saying no objection for allowing the civil revision petition to enable the parties to record the compromise before the Court below.

3. The Memo dated 01.11.2022 filed by the respondents and counter signed by the counsel for the respondent is taken on record.

4. Accordingly, the Civil Revision Petition stands allowed by setting aside the order dismissing the I.A.No.08 of 2022, filed to set aside the exparte order against the petitioner. The petitioner is allowed to participate in the proceedings before the Court below to enable the parties to record the compromise as stated above. No costs.
